Now that DOF has decided 240 redevelopment appeals, the next step shouldn't surprise anybody: The lawsuits are beginning to roll in:

Murrieta has sued DOF over its decision to invalidate two payments – one a $3 million payment to the city from the RDA and the second a $1.2 million payment to developers on an affordable housing project called Monte Vista

Almost 60% of lawsuits filed under the California Environmental Quality Act challenge environmental review projects in infill locations as opposed to greenfield locations, according to a new analysis of 95 recent cases by two lawyers at Holland & Knight.

The new analysis comes on the heels of three other recent studies concluding that CEQA actions are struck down by courts between 40-60% of the time, compared to virtually zero for NEPA.

As cities around the state are still stinging from the state's decision to deny many of their 240 redevelopment appeals, redevelopment skirmishes still continue around the state -- often about affordable housing projects that cities claim are nearing completion. Here's a sampling:

If skepticism about growth is an indication that the economy is on the rebound, then Tuesday's land use elections throughout California might be called good news.

About a dozen land use measures were on the ballot Tuesday and most cases the anti-growth forces won. Most of those that did win were focused on job creation. Several measures focused on downtown development in small cities, with mixed results.

When Jerry Brown first proposed killing redevelopment -- back in January 2011, when he released his first budget -- he said he would replace it with some other economic development tool. After Brown succeeded -- when he released his second budget, in January 2012, just days after the Supreme Court killed redevelopment – his tune changed, ever so slightly. He said he would consider bringing redevelopment back if it didn't affect the state's general fund.

Fair enough.

It's safe to say that the City of Calistoga's Silver Rose Referendum will not be the most important question on the ballot in the this November. Nor will Escondido's general plan measure, nor even a preliminary vote on draining Hetch Hetchy reservoir.

While Gov. Jerry Brown's veto of redevelopment-related bills and the earlier failure of parking reform bill Assembly Bill 904 caused some consternation around the state, he did in fact sign a wide array of bills relating to land use at the end of last month. 

Over the past year, even the most irate objectors to Gov. Jerry Brown's dismantling of redevelopment held out hope that in agreeing to kill redevelopment, the legislature would invent a new, better system for stoking local economic growth. Last week, the governor dashed those hopes.
